02/21/2024 Notice of Proposed Rulemaking

The purpose of the Rulemaking Hearing is to hear public testimony and comments regarding the proposed amendment to the rule: Title 16 Occupational and Professional Licensing, Chapter 12 Nursing and Health Care Related Providers Parts 1, 2, 3, 4, 9, and a new part 14.

Pursuant to the amendment to the Nursing Practice Act, 61-3-23.5 NMSA 1978, the NMBON is mandated to promulgate rules related to General Provisions, Nurse Licensure, Nursling Education Programs, Hemodialysis Technicians, Management of Chronic Pain with Controlled Substances, Nursing Practice of Aesthetic Medical Facilities. No specific technical information serves as a basis for this proposed rule.

The Board is currently accepting public comments on the proposed amendments. Please submit written comments on the proposed changes via email to sheena.ferguson@bon.nm.gov. Alternatively, members of the public may submit written comments by sending an original, signed copy to:

The Board will accept written public comment received at or before 5:00 PM on Tuesday, February 20th, 2024, as well as written public comment hand-delivered between approximately 8:00 a.m. to 9:00 a.m. at the above referenced address on the date of the rule hearing. All written comments will be posted to the Board’s website no later than three business days following receipt to allow for public viewing.
